CELEBRATION AS APPEAL COURT AFFIRMS OBA GHANDI AFOLABI OLAOYE AS SOUN OF OGBOMOSO


The Court of Appeal in Ibadan has upheld the selection and installation of Oba Ghandi Afolabi Olaoye as the Soun of Ogbomoso, overturning a previous ruling that nullified his appointment.

The decision, delivered by a three-member panel led by Justice Yargata Nimpar, ruled that the Oyo State High Court lacked jurisdiction in the case. The appellate court emphasized that the plaintiffs had failed to exhaust administrative remedies before approaching the court, rendering the earlier judgment invalid.

BACKGROUND OF THE CASE

Oba Olaoye, a former pastor and businessman, was selected as the Soun of Ogbomoso in September 2023 following the demise of Oba Jimoh Oyewumi Ajagungbade III in December 2021. However, his selection was challenged by some royal family members, who argued that due process was not followed in accordance with the Soun Chieftaincy Declaration of 1958.

In November 2023, the Oyo State High Court nullified his selection, ruling in favor of the plaintiffs. This decision was immediately appealed, leading to today’s final judgment in favor of Oba Olaoye.

With this ruling, Oba Olaoye remains the legally recognized Soun of Ogbomoso, putting an end to months of legal disputes. However, sources close to the respondents indicate that they may seek redress at the Supreme Court.

The verdict has been met with celebrations across Ogbomoso, as many residents and supporters of Oba Olaoye believe his reign will bring progress and unity to the historic town.
